Karnataka HC upholds disqualification of Prajwal Revanna as JDS MP

The opposing counsel argued that the order disqualifying Revanna, grandson of former prime minister H D Deve Gowda, had already been put into practice and had been communicated to the Speaker of the House.

The Karnataka High Court Monday rejected the lone JDS MP from the state, Prajwal Revanna’s appeal for a stay order against his disqualification as a Lok Sabha MP. The order was passed by a single judge bench of Justice K Natarajan.

Revanna’s counsel argued that he ought to be given a stay on the order since he would not be able to attend the parliamentary sessions otherwise. It was also argued that he would be put to hardship and injury after having won with a record number of votes. The opposing counsel argued that the order disqualifying Revanna, grandson of former prime minister H D Deve Gowda, had already been put into practice and had been communicated to the Speaker of the House.

The bench noted, “Merely because the parliamentary session commences from 18th September onwards, that itself is not a ground for staying the operation of the order when serious corrupt practices were proved…I am of the view that the respondent has not made out a sufficient ground for allowing the application.”

The order of disqualification had been passed earlier by Justice K Natarajan, partially allowing two petitions filed by a voter from Hassan constituency and A Manju, the Lok Sabha candidate who had lost to Revanna in 2019.

The petitions in question had raised allegations of election malpractice as well as improper declaration of assets on the part of Revanna. The petitions were partially allowed by Justice Natarajan, who declared the election of Revanna null and void but rejected the petitioner’s request to declare Manju as the “returned candidate” as he himself was also involved in “corrupt practices”.
