The Karnataka High Court on Friday referred Kannada actor Darshan Thoogudeepa’s request for food and other amenities to the lower trial court. Thoogudeepa is an accused in the Renukaswamy murder case and had approached the Court requesting home-cooked food, along with cutlery, bedding, and books, stating that he had fallen ill and lost weight on account of the food served in prison.
In the initial hearing last week, Thoogudeepa’s counsel had argued that this was allowed under the Karnataka Prisons Act, while the government counsel had opposed it arguing that the provision does not apply to a murder accused. It was also argued that Thoogudeepa should have moved an application before the Inspector General of Prisons and the trial court.
The bench observed that the question was whether the right granted under the Karnataka Prisons Act would be absolute or not, observing that an interim order could not be passed as the matter had to be heard in detail.
Referring the matter to the lower court, the bench ordered, “Petitioner (Thoogudeepa) is reserved liberty to move an appropriate application before the learned Magistrate… seeking reliefs of home food/outside food, bedding, etc., by getting the case advanced to 20th July… The learned Magistrate is directed to consider and dispose of the said application on or before 26 July.”
Thoogudeepa was arrested along with Pavithra Gowda and 11 others on June 11 over the murder of Renukaswamy, a resident of Chitradurga. Four other accused people were arrested later.
