HC petition puts top official in dock

The two petitioners,Manish Shah and Dr Vasant Patel,have sought a direction to the secretary to hear their petition opposing permission for the operation of the multiplex.

Two residents of Vastrapur area in the city have alleged in a petition before the Gujarat High Court that information secretary K Kailashnathan has not been hearing their application related to a multiplex in Alpha One Mall in Vastrapur citing his busy schedule.

The two petitioners,Manish Shah and Dr Vasant Patel,have sought a direction to the secretary to hear their petition opposing permission for the operation of the multiplex.

The court has issued notice to the respondents,including the secretary. According to the counsel for petitioners,they have been objecting to the multiplex in the mall on the ground that it is against the statutory provisions.

The matter first went to the Ahmedabad district collector and after a series of litigation before the collector,the secretary in the information department and the High Court,it has now again reached the secretary for fresh hearing. Under statutory provisions,information secretary has got quasi-judicial powers and works as an appellate authority in such matters.
