Harni boat capsize: Gujarat HC adds Kotia Projects, school as parties in PIL seeking ‘exemplary damages’
The applicant, Kalpesh Nizama, sought that Kotia Projects and New Sunrise School be made liable to pay exemplary damages.

Allowing an application filed by the relative of one of the 12 students who died in the Harni lake boat capsize incident in Vadodara in January, the Gujarat High Court on Friday directed that Kotia Projects – which was given the contract to develop and maintain the lake – as well as the school management, be added as parties to a suo motu a public interest litigation initiated by the HC.
The applicant, Kalpesh Nizama, sought that Kotia Projects and New Sunrise School be made liable to pay exemplary damages.
On January 18, a boat had capsized in Harni lake, killing 12 students and two teachers, who were on a school picnic.
Submitting that New Sunrise School had organised the picnic, as part of which around 80 students were taken to the lake, Nizama told the court through his advocate that the exercise was undertaken by violating government norms, which requires schools to take permission from the district education officer for school excursions.
Permitting the application, the HC allowed the two to be added as parties and issued them notice.
