Constitution does not allow law to ensure 85% local workforce in industries, Minister tells Gujarat Assembly
Rajput said that all the units in Kheda were following the provisions of the resolution whereas, only one unit of Sabarkantha was found to be violating the same in the last two years.

The Gujarat government on Thursday said that it cannot bring a law to ensure 85% local work force in industries in the state as the same cannot be done under the provisions laid down in the Constitution. Labour, Skill Development and Employment Minister Balvantsinh Rajput said this in Gujarat Assembly while replying to a question from the Congress in this regard.
During the Question Hour on Thursday, a question was raised by Congress legislator from Khedbrahma constituency of Sabarkantha district, Tushar Chaudhary, who sought to know the number of industrial units from Sabarkantha and Kheda districts that were found to be violating the provisions of a resolution of the Labour and Employment department (dated March 31, 1995), under which industrial units have to maintain 85% local employment.
Rajput said that all the units in Kheda were following the provisions of the resolution whereas, only one unit of Sabarkantha was found to be violating the same in the last two years.
In a supplementary question, Chaudhary said, “You have issued a resolution which nobody is implementing. In that case, instead of the resolution, do you want to bring a strong law so that the industries follow the same and 85% locals get employment?”
Chaudhary also alleged that industrial units receive all incentives from the state, but when it comes to providing employment to locals, they do not follow the resolution.
Rajput, meanwhile, claimed that 89% locals in Sabarkantha, and 95% in Kheda get employment. He added that in India, Gujarat leads in terms of providing employment.
“As per Constitution, no state can make (such a law). In Karnataka, where the Congress is in power, an attempt was made to make such a law. They have not been able to make the law till date,” the minister said, adding that the state government is making every effort to ensure that locals get maximum employment.
