Amin’s bail plea rejected

A special CBI court Tuesday rejected the bail plea of suspended deputy superintendent of police N K Amin,an accused in the Ishrat Jahan encounter case

A special CBI court Tuesday rejected the bail plea of suspended deputy superintendent of police N K Amin,an accused in the Ishrat Jahan encounter case, who had sought default bail on the ground that CBI had failed to file a complete chargesheet in the case within 90 days of his first remand or custody after the arrest.

Additional Chief Judicial Magistrate S H Khutwad rejected the plea saying he had filed default bail plea within 90 days, while the provision was that such an application had to be filed only after 90 days, that too if the chargesheet was not filed during the period.

Earlier, five other policemen arrested in the case were released on default bail after CBI could not file the chargesheet on time.

Amin is among the eight policemen chargesheeted by CBI in the case. He is accused of firing five rounds from his pistol on June 15,2004,when 19-year-old Ishrat Jahan and three others were killed in a police encounter on the outskirts of Ahmedabad. Amin is also an accused in the 2005 Sohrabuddin Sheikh encounter case.
