On November 2, 2007, Raja wrote the first letter to Singh, justifying the cutoff date of September 9. The CBI alleged that in this letter, Raja incorrectly described as out of context the opinion of the law ministry that the matter should be referred to the empowered group of ministers.

CBI Special Judge O.P. Saini deferred the matter observing that documents filed in the case are "voluminous and technical in nature" which were still under perusal. On November 7, the court might decide on the date of pronouncing judgement.
