Govt will appeal on Maratha quota in SC next week

Tawde said, “At the meeting today we discussed some of the aspects questioning that legality of the Maratha reservation by the Bombay HC.

The state government is likely to appeal against the Bombay High Court’s decision to reject Maratha reservation in Supreme Court next week. The Maratha reservation committee headed by education minister Vinod Tawde on Wednesday held its first meeting. At the end of the meeting held at Mantralaya (Mumbai), Tawde said, “ We are planning to appeal in Supreme Court against Bombay High Court’s decision to reject Maratha reservation next week Tuesday or Wednesday.”

Tawde said, “At the meeting today we discussed some of the aspects questioning that legality of the Maratha reservation by the Bombay
High Court. We consulted the legal officials and advocate general Sunil Manohar and former Advocate General Darius Khambata.”

The state government set up a committee lead by Tawde to find way forward to press its demand for the 16 per cent reservation for the
Maratha community in public services and education. The members in the committee present at the meeting were NCP leader Ajit Pawar, Shiv Sena leader Eknath Shinde, Shivsangram leader Vinayak Mete et al.

The Prithviraj Chavan lead cabinet had given the nod for Maratha reservation before the state assembly elections. However, last fortnight Bombay High Court stayed the reservation for Maratha community. Tawde admitted, “ The reservation which was based on findings of the
Narayan Rane committee report had some shortcomings. We will need to substantiate those aspects when we appeal in apex court.”

The two aspects that are being debated are how to establish the social backwardness of Maratha community which is politically dominant in Maharashtra. All political parties who are justifying the reservation believe the economically backward amongst the community which has 30 per cent population can qualify for the quota. But legally questions have also been raised about the percentage of economically
backwardness of the community.
