CBI opposes Amin’s bail plea in Ishrat case

Amin is the only policeman behind the bars in the case.

The Central Bureau of Investigation on Wednesday opposed the bail application of suspended Deputy Superintendent of Police N K Amin in connection with the 2004 Ishrat Jahan fake encounter case. The CBI in its brief reply said if bail is granted to Amin, the only policeman behind the bars in the case, he may tamper with the evidence.

The agency filed the reply before the special CBI judge K R Upadhyay and would likely argue against the bail application on Friday. In a two-page reply, it said: “The charges against him (Amin) is elaborated in the chargesheet and therefore there is no need to divulge the same information in the reply.”

Amin is accused of participating in abduction, illegal confinement and firing at Ishrat Jahan, her friend Javed Sheikh alias Pranesh Pillai and two Pakistani nationals Amjadali Rana and Zeeshan Johar. The CBI chargesheet said that Amin fired five rounds from his 9mm pistol.

Amin is the only accused policeman who is in jail, whereas the rest six accused policemen, including ADGP PP Pandey, retired DIG D G Vanzara, IPS officer GL Singhal, are out on bail. The chargesheet against four IB officials, including former special director Rajinder Kumar, is pending with the court for more than a year awaiting the central government’s nod for prosecuting them.

Appearing for Amin, senior advocate Mitesh Amin argued for bail mainly on two grounds — parity with co-accused who have been given bail and the poor health of the accused.

Amin’s lawyers argued if Vanzara and Pandey, who are facing similar charges, can be granted bail, then his client should client should also be out of jail. On the charges of firing at Ishrat and others, the defendent told the court the forensic report does not reveal that bullets recovered from the scene were fired from Amin’s revolver.

Amin said parity should be given even on the default bail granted to Singhal and the rest three accused policemen, whose roles in the encounter were similar. He said that default bail was granted by the court after the CBI did not file the chargesheet in time.

Amin, who is also an accused in the Sohrabuddin Sheikh encounter case, also sought bail on medical grounds, saying he is suffering from various ailments.
