Even as the Supreme Court set aside a Bombay High Court order that had stayed a lower court order asking the police to register a case against Director General of Police A N Roy and six other police officers,the Vakola police who are supposed to file an FIR against the top cops are yet to take any action. According to the Vakola police,they are still awaiting a copy of the apex court order. However,Raj Awasthi,the person who had complained against the senior police officers for falsely implicating him in a MPDA case,claimed that he had sent a copy of the certified court order to the Vakola police on Tuesday.
Awasthi said,I had received a copy of the certified order a few days ago and sent the copy to the Vakola police station on December 1. However,I have been told that no action has been taken so far. The police are still dragging their heels on it.
When contacted,Senior Police Inspector Anil Kharade of the Vakola police station said,I have not received any copy of the SC order.
A Bandra metropolitan magistrate in 2008 had ordered the Vakola police to register a case against the then Commissioner of Police Roy,two deputy commissioners of police and four other officers for allegedly using forged documents to detain Raj Awasthi under the Maharashtra Prevention of Dangerous Activities (MPDA) Act. Awasthi was detained on January 3,2006,after Roy gave his permission to take action against him relying on several documents,mostly non-cognizable complaints. Awasthi used the Right to Information (RTI) and found that the alleged complaint against him by Ehsanul Jabbar Siddiqui from Kurla was never filed in a police station. Awasthi approached the metropolitan magistrates court seeking legal action against the officers for forgery and false implication.
In June,the officers had approached the High Court after which the court had granted a stay on the proceedings against them. However,Awasthi moved the Supreme Court and the stay was vacated. Following this,the state moved an application in the Supreme Court against the SC order but the application was disposed of. The apex court held that the FIR has to be filed and investigation has to be carried out.
