The alleged accidental death of a 27-year-old engineer last year has now prompted the Bombay High Court to call the head surgeon of Nagpada police hospital to verify the reports to ascertain the actual cause of death.

Jeevan Dudhane was found dead on November 2 last year in his car after he left his Borivali home the previous night to attend a bachelor’s party thrown by his friend Devesh Mohta at Hotel Sea Princess in Santacruz. The police report held that it was accidental death due to overdose of alcohol.

However, victim’s father Raju had moved the High Court claiming that his son was murdered and challenged the police report.

A division bench of Justice Ranjana Desai and Justice Rajesh Ketkar on Tuesday directed head surgeon S M Patil along with assistant professor from G T Hospital to go through the various reports like post mortem, histopathology, inquest panchnama and chemical analysis among others. The court asked them to submit the findings to the court within two weeks and hear the case after three weeks.

Petitioner had taken expert opinion from another doctor following the postmortem report. Forensic medicine expert Dr Rajendra Bagal had opined that the report was “not only erroneous but also unscientific.”

Dudhane’s advocate Mallika Ingale earlier told the court that the report brings out at least 15 lapses in Jeevan’s post-mortem (PM) report filed by the medical officers of the JJ Hospital.

Among many anomalies pointed out by Bangal,he has said the PM report is silent on the time of death which can be determined from the stiffness of the body. He adds that the body does not change its position after four-five hours of death. Jeevan was found dead in his car in the same position as he is seen in a photograph on his cell phone at 3:06 am,which means he was dead four-five hours before that photograph was taken.
