NEW DELHI, Aug 14: A Delhi court today decided to depute a commission to Canada for the examination of prosecution witness WE Miller in the one lakh dollar Lakhubhai Pathak cheating case. Special judge Ajit Bharihoke issued the order in the wake of a CBI application on July 4 that it wanted to examine the Canadian witness.

Bharihoke in his order said, “A letter of request for examination of Miller be sent to concerned judicial authority through Ministry of External Affairs with further request to permit the prosecution and defence for assisting the commission in examination and cross examination.”

Former Premier P V Narasimha Rao, godman Chandraswami and his aide Kailash Nath Aggarwal are facing trial in the case for allegedly cheating London based businessman Lakhubhai Pathak who died in London in May this year. Bharihoke asked defence counsel to move applications in the court on July 22 on the question of sending accused persons alongwith the commission.
