In a relief for former director general of Indian Council of Medical Research Prof N K Ganguly,the Supreme Court on Tuesday restrained the CBI from arresting him in connection with the alleged illegal transfer of Rs 70-crore tract of public land to build private society flats.
A Bench led by Justice Gyan Sudha Misra also sought response from the CBI on Gangulys plea to quash the criminal proceedings arising out of the FIR registered by the CBI in November 2010 under the IPC and Prevention of Corruption Act.
Issue notice. In the meanwhile the arrest of the petitioner shall remain stayed, said the court while allowing the interim relief to 71-year-old Ganguly.
The FIR alleges that Ganguly,pursuant to a criminal conspiracy with other retired top brass of the ICMR,in 2006-07 transferred a Rs 70-crore tract of prime government land in Uttar Pradeshs Noida in the name of a private group housing society by paying just a fraction of its market value. As per the CBI,10 of such officials,including Ganguly,later got residential flats constructed on this plot and obtained undue pecuniary advantage to the tune of Rs 13.14 crore.
The CBI filed its chargesheet against 12 persons,including Ganguly,former director of Institute of Cytology and Preventive Oncology Dr B C Das and several other former senior officials,for allegedly abusing their official positions.
