Larger Bench to hear plea against CIC order on judges appointments

A Supreme Court Registry appeal against bringing the appointment and transfer of the higher judiciary under the transparency law.

A Supreme Court Registry appeal against bringing the appointment and transfer of the higher judiciary under the transparency law may be heard by a larger Bench after the Attorney General on Thursday submitted that any decision on the case will concern the crucial question of judicial independence.

The court had appealed to itself on December 1,2009 against a CIC decision that information on the appointments,especially when it involves the superseding of seniors,and transfers of judges should be brought under the RTI Act,2005.

A two-judge Bench,led by Justice Sudershan Reddy,reserved the Registrys appeal for final orders on submissions made by AG G E Vahanvati,appearing for the SC,that the matter be placed before a Constitution Bench.
