Lying in the CBI chargesheet in the 2G case are details of criminal conspiracy among the prime accused to grant licences to certain companies,while denying the same to others. Noting that cut-off dates were manipulated,the agency says: R K Chandolia,PS to A Raja,had been continuously monitoring the status of receipt of applications. On 24.9.2007 he enquired from the concerned officer as to whether applications of Unitech Ltd for new UAS licences had been received and directed that no application should be accepted after the receipt of applications from Unitech Ltd,which were expected to be received on the same day. In the meantime,Unitech MD Sanjay Chandra caused to make applications by 8 companies formulated for this purpose. These companies were renamed after they got UAS licences as Unitech Wireless Group companies. The decision on cut-off date was decided in conspiracy with Chandra and Swan Telecom Directors Shahid Balwa and Vinod Goenka to rope in the applications of Unitech Wireless (Tamil Nadu) Pvt Ltd for many circles and offering Delhi circle to Swan Telecom,says the chargesheet. Accusing Raja of misrepresenting the facts and misleading the PM,the agency notes that Raja called Chandolia to his camp office at his residence on 2.11.2007 to draft a response to PM Manmohan Singhs letter that availability of spectrum had to be assessed before commiting to issue licences. As a result of the conspiracy,Swan Telecom was the first to submit compliances for Delhi (where spectrum was limited for one licence only) and Mumbai circles,and Unitech Wireless was able to get priority in all circles over many applicants which had applied much before it,says the agency. The chargesheet also says the accused managed to get certain applications of eligible companies received by the Department of Telecommunications disappear and these have remained untraced since then. Raja also kept files of eligible companies pending and did not accord these in-principle approval for long. Bringing Reliance ADAG senior officials into the net of criminal conspiracy,the chargesheet says: ADAG Senior V-P Hari Nair,in collusion with ADAG Group MD Gautam Doshi and senior V-P Surendra Pipara,structured different companies. As company secretary of Swan Telecom,he dishonestly submitted false information to DoT regarding its shareholding by various companies.
