In an interesting judgment on a bail plea,Justice R Regupathy of the Madras High Court on Tuesday directed eight persons in prison for burning the Tricolour during pro-Lankan Tamil protests to hoist the flag everyday at their residences for one week as a condition for allowing their bail.
Tamilarasan and seven others were arrested and remanded by the police for burning the Indian flag in front of the Coimbatore collectorate on April 25 when the protests against the continuing war in Sri Lanka between the Army and the rebel LTTE were at their zenith.
The protesters, belonging to regional outfits like Tamil Desiya Viduthalai Iyakkam and Tamil Desiya Pothu Udamai Katchi, alleged that the Indian Government was giving covert support to the Lankan army in the war. They were staging various forms of protests across the state.
A lower court refused bail to the eight who were arrested under the charges following which the detainees moved the Madras High Court for securing bail.
When the case came up for hearing,Justice Regupathy pointed out to the petitioners that the national flag was a matter of pride for any countrys citizens. To respect national flag is the duty of all citizens, said the judge, ordering the protesters to install a flag pole at their homes and hoist the national flag from 6 am to 6 pm everyday for the next one week. The police would check everyday whether the pre-condition was being met,Regupathy added.
