Haryana govt says nothing wrong in deal

‘No revenue loss to the govt,stamp duty & registration charges paid as per law’

The Haryana government Sunday maintained that no wrong was committed in grant of licence or renewal thereof to Robert Vadra’s company. The state government said the mutation between Sky Light Hospitality Ltd,owned by Vadra,and DLF Universal Ltd is valid even today.

The same mutation was cancelled by former director general,Consolidation of Land Holdings,Ashok Khemka in October last year. However,the Haryana government has refused to accept Khemka’s cancellation orders and called the mutation valid.

Reacting to the media reports on the report submitted by Khemka,the Department of Town and Country Planning (DTCP) said,“The sale deed and mutation by which Sky Light Hospitality Pvt Ltd became the owner of the land in question is valid even today and nobody has challenged the same till date. As far as the exchange of sale consideration is concerned,it is a matter between private parties which cannot be gone into by the director. It is reiterated that no fake papers were submitted to the department as alleged. Further there was no revenue loss to the government as stamp duty and registration charges were paid as per law on execution of this sale deed.”

The Department of Town and Country Planning said,“Regarding the ownership documents being called as ‘sham’,it is submitted that for the purpose of grant of licence,the Haryana Development and Regulation of Urban Areas Act,1975 requires the director to enquire into the ownership of the land before grant of any licence. In order to confirm the ownership of land,the department relies not only on the sale deed entered into by the present owner for purchasing the land from its erstwhile owner but also on the entries in the revenue records i.e. the intkaal (mutation) entered into by the revenue authorities after following due course of law. Once the intkaal in favour of an applicant is presented to the department for a particular piece of land,the department is bound to accept the ownership of land in favour of such applicant. This is the standard procedure followed for grant of licence,which has been followed in the licence case pertaining to Sky Light Hospitality Pvt Ltd also.”

“Similarly all requirements and formalities required to be completed by any applicant for the purpose of issue of LoI (Letter of Intent) and for grant of licence as per the norms and parameters applicable during the said period were completed by Sky Light Hospitality Pvt Ltd also and thus there is absolutely no irregularity is the issue of LoI or in the grant of licence in the said case,” the Department of Town and Country Planning said.
