Court allows MCD to charge higher rate for land at Goga

The Delhi High Court today allowed MCD to go ahead with its decision to charge the land price at Rs 7000 per square metre per plot in Goga Dairy project in Narela.

The Delhi High Court today allowed MCD to go ahead with its decision to charge the land price at Rs 7000 per square metre per plot in Goga Dairy project in Narela.

Dismissing a batch of petitions filed by a group of applicants challenging the civic agency’s decision to charge Rs 7000 per square metre instead of Rs 2500,Justice Rajiv Sahai Endlaw directed the petitioners to buy the plot at the new rate fixed by MCD.

The court allowed the agency to cancel the allotment of the land in case the petitioners fail to pay the land cost at the latest price.

It also directed the petitioners to pay the differential amount to MCD in case they have paid the land cost at the old rate.

“….MCD while developing the scheme is fully entitled to grant the said concession. MCD is thus entitled to demand the price of Rs 7000,” said the court.

Approaching the court,the petitioner submitted that following this court’s direction the unauthorized dairies were directed to shift to Narela and the civic agency was asked to develop the Goga dairy project over 189 acre of land.

In 2004,they claimed to have applied for the plots at the rate of Rs 2500 per square metre,including the cost of road,drains,electricity,water,sanitation and other works,and also deposited 50 percent of the total amount.

As per the contract,they had deposited with the agency 50 percent of the total land amount,they also claimed.

However,MCD had taken a decision last year and started demanding Rs 7000 on the ground that the cost of material for development of the project has gone up and the agency was required to hike the land price.

The court accepted MCD’s argument that besides the cost of material for development area,market price of the land has also gone up and the agency was giving the land at concessional rate which is much less than the market price.
