The CBI on Tuesday requested a city court through its counsel to summon chairman of ADA Group,Anil Ambani, his wife Tina Ambani and 11 others as witnesses in the 2G spectrum case.
UU Lalit,public prosecutor representing CBI,told the court that the Ambanis were required to explain the structuring and investment into the shell companies involved in the alleged scam.
Lalit told the court that the Ambanis testimony was required to shed light on seven facets in the case: who took the decision to incorporate the shell companies; the interlocking equity structure of the shell companies; the corporate restructuring of Swan Telecom; the investments and divesments made into and out of Swan Telecom; the application process followed with the Department of Telecom and the transfer of Swan Telecom to DB group in 2007.
The witnesses,so far,have not been clear on who took the decision to incorporate the shell companies regarding the radiowaves allocation and who was involved in their restructuring, Lalit told Special Judge OP Saini. He said that if one of the Ambanis gave a clear answer,the others testimony would not be required.
The prosecutions request was met with objections by the defence counsel.
Allowing the prosecutions application would amount to a re-trial and seriously prejudice the defences case, Vijay Agarwal,counsel representing Swan Telecom promoter Shahid Usman Balwa told the court.
The matter has been listed for further arguments on Wednesday.
