NEW DELHI, DECEMBER 14: A special court today issued Non-Bailable arrest Warrant (NBW) against Dubai-based Indian businessman Win Chadha and granted bail to former Defence Secretary S K Bhatnagar in the Rs 64-crore Bofors pay-off case.

Special Judge Ajit Bharihoke issued the NBW against Chadha, a former agent of Swedish arms manufacturing firm A B Bofors, as he failed to appear before it despite summons served on him. The NBW is returnable on February three, 2000, the next date of hearing.

Win Chadha had refused to accept the summons served through the Indian embassy. His lawyers had cited several provisions of the Indian law, including Section 7 (a) of the CrPC, about the manner in which summons were to be issued to Indians residing abroad, counsel said.

The court granted bail to Bhatnagar on a personal bond of Rs two lakh and a surety of the like amount as investigation regarding his alleged role in the conspiracy was over.

The court also issued fresh summons to Martin Ardbo, former president of A BBofors – now renamed as Celsius, with the direction that the copy of the summons along with its translated version in Swedish language be forwarded through the Indian embassy there. Ardbo had not accepted the summons earlier as they were not in Swedish language.

The court also granted time to CBI to execute the NBW against Italian businessman Ottavio Quattrocchi as CBI counsel N Natarajan submitted that the procedural formalities regarding his arrest and extradition were yet to be completed. Natarajan informed the court that a CBI team had gone to Malaysia, where Quattrocchi is supposed to be residing, and handed over the requisite documents to the Malaysian authorities.

CBI alleged that Quattrocchi’s A E Services received $ 7.3 million, while Chadha’s Swenska got $ 27 million as kickback from A B bofors for helping the latter in getting the contract in March, 1986.

The agency alleged that Rs 64 crore kickbacks were paid to middlemen in the Rs 1,437 crore gun deal with the Swedish company A B Bofors.
