The wife of the Deputy Superintendent of Police who has been arrested by the Central Bureau of Investigation (CBI) for his alleged involvement in the J-K sex abuse scandal, today moved a bail application in the court of the Chief Judicial Magistrate, Srinagar.

Earlier, she had applied for his bail in the High Court (HC) after the Division Bench monitoring the CBI investigation into the matter had barred any lower court from granting bail to the accused unless the matter was brought to its notice.

‘‘No court will grant bail without first bringing the matter to the notice of the court,’’ the HC had observed in a hearing on the PIL filed by the Kashmir High Court Bar Association on May 19.

‘‘The CJM has the authority to issue bail. The High Court has only directed that it should get prior information, in case the bail is issued,’’ Assistant Solicitor General and CBI counsel Shabir A Naik said.

Meanwhile, a Deputy Inspector General of Border Security Force met DIG K S Padhi in Srinagar Central Jail on Monday.

Padhi had surrendered to the CBI on June 7 after he was named by the minor victim as one of the senior security officials who had raped her.

According to sources, there were protests by the inmates in the Central jail against the kingpin Sabeena when the CJM, Srinagar, extended her remand for 14 days on June 8.

The Jammu & Kashmir government is believed to be mulling the constitution of a special court once the chargesheet against the accused is produced.

Additional Advocate General Muhammad Amin Rathore, who represents J-K government in the High Court, will prepare a report on the objections.
