CHENNAI, Sept 17: `Fake’ saint Premananda, who was sentenced to undergo life imprisonment for two terms and fined to pay Rs 66.40 lakh by the Sessions Judge, Tiruchi, has been directed by the Madras High Court to deposit Rs 36.40 lakh in the main branch of the Indian Overseas Bank in Tiruchi.
A division bench comprising Justice N K Jain and Justice A Ramamurthy, which gave the direction, rejected the plea of Premananda to grant him interim bail to raise the money, to be paid as compensation to the rape victims. It also rejected Premananda’s another plea to stay recovery of the large amount from him.
Dismissing a petition from Premananda, the bench observed that it is clear from Sec. 357(1) CrPC that the trial court is empowered to award compensation to the victims from out of the fine amount. The power to award compensation is not ancillary to other sentences. But it is in addition thereto with an intention to reassure and to reconcile the victims. The offence of rape is not against the victim only. It isagainst the entire society.
In an appropriate case, the trial court is empowered to order interim compensation also, pending an appeal. In this case, the petitioner is a Sri Lankan, alleged to be a saint. He had set up an ashram in Tamil Nadu. The trial court judge had come to the conclusion, considering the relevant material, that sufficient funds are in the bank accounts of Premananda and co-accused Divya Mathaji, who is absconding.
