CHANDIGARH, June 17: In an attempt to prevent his "in-laws" from solemnising the second marriage of his "wife", a "husband" has moved a City court.
Taking up the application, UT Sub Judge (Ist Class) K. C. Garg has issued notice to the defendants. The case will now come up for further proceedings on August 4.
The plaintiff, Vipon Kumar of Sector 20, had earlier alleged that the "in-laws", refusing to acknowledge their wedding, were getting their daughter remarried. They had even threatened him with dire consequences in the event of his interfering in the ceremony, he had stated.
Their “wedding was solemnised” under the auspices of Arya Samaj on April 14 this year at the Sector 16 mandir, it was stated.
But the daughter was forcibly taken away by the parents a few days after the marriage as they were unhappy with the union, he alleged.
A petition under Section 9 of the Hindu Marriage Act for restitution of conjugal rights was filed before another court after the plaintiff failed to persuade the "in-laws" to send the daughter with him. The matter was still pending, he said. The "husband" and "wife" were adults when the marriage was solemnised and all the conditions mentioned in the Hindu Marriage Act had been fulfilled by them, it has been added in the plaint.
