CHANDIGARH, June 2: UT Judicial Magistrate (Ist Class) K.C. Garg today reserved order till June 4 on application for summoning the complainant and an ASI to verify the authenticity of a cassette enclosed with a City resident’s bail plea. The bail application will also be decided on the same date.
The cassette, according to the defence counsel, contained wife Reena Babbar’s conversation over the telephone with her sister at Nahan about implicating husband Kuldeep Babbar and his relatives in serious offences. Also allegedly recorded was ASI Harjit Singh’s conversation with the complainant’s brother at Jalandhar.
Today, opposing the bail plea, the counsel for the complainant stated that cassette could not be considered as evidence by the court at the current stage. The defence counsel, on the other hand, contended that the court had jurisdiction to examine evidence at any stage.
It may be recalled that Kuldeep Babbar was earlier booked by the Chandigarh Police for alleged criminal breach of trust and subjecting his wife to cruelty on the statement of the wife, Reena Babbar. In her complaint, she had alleged maltreatment and dowry demand by her husband.
