MUMBAI, FEBRUARY 13: Rubina Javed Sayed, sister of Abu Sayamma alias Javed Fawada, today denied that she was instigated to give false evidence at the instance of some politicians.

On the concluding day of her cross-examination by Mumbai Police counsel Shrikant Bhat, Rubina denied that she had falsely deposed that she visited the Killa court on September 1, 1997, and that her brother was an associate of Javed Kaliya, an Abu Salem gang member. She further denied that her brother was also referred as Javed Fawda because of his protruding upper gums and teeth, and that she was aware that her brother had been killed in a police encounter when she visited the Palton Road Police station. She denied having lied about seeing Fawda in Behrampada, and said he had hurt a person’s eye and was later identified by the crowd collected there as Javed Fawda.

The next witness in the inquiry conducted by Principal Sessions Judge A S Aguiar said Javed had been selling peanuts for about five years, and was last seen at hiscart on August 25, 1997. The witness, Nannu Macchan Khan, who sells footwear close to where Javed would sit, said in the examination-in-chief conducted by Samajwadi Party Counsel Majeed Memon that he had learnt that Javed was taken away by some policemen and was missing. The witness said he knew Javed was a nice person. He was unaware that Javed was in custody from November 27, ’96 to January 13, 1997.
