After arguments that lasted three days, the Bombay High Court on Wednesday rejected suspended police sub-inspector Daya Nayak’s anticipatory bail plea, along with the plea filed by his associate Rajendra Padate, in the disproportionate assets case against them.

The court, however, did grant anticipatory bail to Nayak’s wife Komal on a bond of Rs 25,000 and sureties of a like amount. She has also been ordered to visit the Anti-Corruption Bureau (ACB) office every day for the next week, after which she must appear whenever the ACB wants.

Delivering his ruling, Justice V M Kanade rejected Nayak’s plea on the grounds that huge transactions attributed to Komal needed to be further probed, and declared that custodial interrogation was necessary for further investigation.

Padate, meanwhile, was denied advance bail pending further investigation into a transaction of Rs 30 lakh involving Komal’s bank account.

The judge has, however, granted both men a week’s time to surrender.

Though Nayak can still appeal the order in the Supreme Court, his lawyer Shirish Gupte told the court they had not sought extra time to do so.

Meanwhile, the court has ordered the ACB to place Daya in a separate cell when arrested, considering that Nayak’s life might be in jeopardy since he is a policeman and encounter specialist.

Nayak, who has killed 83 gangsters in alleged encounters during a decade-long career, has been charged with possessing assets disproportionate to his known sources of income and charged under the Prevention of Corruption Act. Komal and Padate are facing allegations of helping Nayak launder his ill-gotten wealth.
