PATNA, June 27: The Patna High Court today granted anticipatory bail to former Chief Minister and senior Congress leader Jagannath Mishrain case no RC-20(a)/96 dealing with the conspiracy angle of the Rs 950 cr fodder scam. Chief Minister Laloo Prasad Yadav also moved the Patna High Court against a special court order rejecting his anticipatory bail.
Justice Dharampal Sinha granted the bail to Mishra on furnishing of two sureties for Rs 50,000 each. In his order, the judge said that at this stage there is no need of going deeper into the merits of the case as it may prejudice the interest of other parties.
Sinha observed that in the first information report nothing has been said about Mishra and there is no concrete evidence regarding his direct involvement in the fake withdrawals.
The judge questioned the CBI counsel that when the investigating agency did not deem it proper to arrest Mishra during the stage of the investigations, what was the justification in opposing his anticipatory bail application after completion of the investigation and submission of the chargesheet before the designated court.
The judge said Mishra had remained the Chief Minister of Bihar more than once was presently a member of the Rajya Sabha. Besides, he has been suffering from several ailments.
Laloo also moved the High Court against a special court order rejecting his anticipatory bail in the fodder scam.
The designated court of SK Lal had on Wednesday rejected Laloo’s anticipatory bail prayer saying there appeared to be prima facie involvement of him (Laloo) in the scam.
Ministers Bholaram Toofani and Vidyasagar Nishad and former Union minister Chandradeo Prasad Verma also filed separate anticipatory bail petitions in the designated court in other cases of the scam. All these applications will be heard on Monday by Justice Dharampal Singh.
