In Kerala High Court, PIL to make Marad inquiry report public

A PIL seeking a direction to the Kerala government to publish the report of the Marad judicial inquiry commission was filed in the Kerala High Court today. The riots in May 2003 had claimed nine lives at Marad in Kozhikode.

The petitioner, People’s Forum for Natural Justice, said the non-publication of the report, submitted to the government on February 20 this year, and the government ‘‘inaction’’ in taking follow up action was ‘‘illegal, irregular and arbitary’’.

It claimed the government was treating the report as a ‘‘secret document’’ and had not examined the same till date and taken no follow-up action.

While appointing the commission, various aspects were directed to be inquired into, including the facts and circumstances which led to the incident, involvement of external or internal organisation in the planning and execution of the incident and any lapse on the part of police or administrative machinery.

The commission’s findings on these issues were also ‘‘vital’’ and should be brought to the notice of the public, the petitioner said. It also urged the government to initiate follow-up action to ensure such incidents do not recur in the future. The petitioner also sought a direction to the CBI to register a case and investigate the offences committed.
