The Calcutta High Court said on Wednesday that any decision taken by the Indian Institute of Management, Calcutta (IIM-C) on a fee cut, would be subject to its decision on the suit filed by the IIM-C Faculty Council seeking a stay on the resolution framed by chairman YC Deveshwar, after a March 26 meeting of the board.
The first hearing of the case took place on Wednesday.
Justice Pinaki Ghosh who heard the case, said on Wednesday that the court would hear the Faculty Council’s petition some time in August, or six weeks after the court reopens from the summer vacation. Meanwhile, all parties concerned have been asked to file their affidavits.
The IIM-C Faculty Council has challenged the resolution of chairman YC Deveshwar to cut fees, framed on the basis of a meeting held on March 26. Deveshwar agreed to slash the fees from Rs 1.25 lakh a year to Rs 30,000, bringing IIM-C in line with the directives of the Union Human Resource Development Ministry.
IIM-C has already sent out letters to candidates selected for this session, seeking a deposit of Rs 29,000 with an undertaking that they would pay the balance if required by the Supreme Court, which is currently hearing the case.
Counsel for the faculty, M.C. Dutta, told The Indian Express: ‘‘We argued before the court that the delegation of the authority of the entire board to the chairman, or any other single member, was legally impermissible and we also argued that Deveshwar’s resolution was subversive to the Supreme Court proceedings.’’
A member of the IIM-C faculty, P.K. Sett, said: ‘‘We are happy with the court’s decision and we will fight and see to it that the resolution is not adopted.’’
