NAGPUR, JULY 17: The High Court bench here dismissed on Friday the contempt plea against R A Sayyad, Investigating Officer (IO) for the bogus degree and mark-list scam that has hit the Nagpur University.
The division bench, comprising Justices G D Patil and A B Palkar, pronounced the operative part of their order, stating that the plea had been dismissed. A detailed order will be released on July 19.
The dismissal paves the way for the single-judge HC bench’s ruling on the criminal revision plea moved by the police against the Special Court’s (Prevention of Corruption) order of July 3 that continued the stay on the PCR of prime accused Yadav Kohchade, granted by JMFC Govind Masand on June 29.
Kohchade’s wife, Kusum, had moved the contempt plea on July 1, stating that the accused was illegally detained in custody at the Sitabuldi police station, despite the Special Court’s directive to shift Kohchade to Central Jail under judicial custody.
On June 30, the Special Court granted a two-day stay on JMFCMasand’s order remanding Kohchade to police custody for 14 days. The stay was subject to a final decision on the revision application of Kohchade’s lawyers against the PCR.
