Patna High Court has asked the state to explain by August 21 how a person accused in a criminal case can continue as Bihar Public Service Commission chairman. BPSC chairman Laxmi Rai, chargesheeted in a CBI case, was in jail for three months.

‘‘It appears, the BPSC has lost people’s confidence and is not in position to work according to the Constitution,’’ observed the court, hearing a PIL over vacancies in Patna Medical College Hospital. The court has asked for BPSC records of last five years and list of vacancies filled by the commission. The HC has asked for a list of vacant posts in PMCH and what BPSC is doing.

Rai took over in 1999 when he had a criminal case against him in the 1996-Combined Engineering Examination scandal. He was let out as the CBI failed to file the chargesheet in 90 days.
