MUMBAI, JAN 9: High-profile Justice Ashok A Desai, popularly known as the green judge of the Bombay High Court, particularly after his landmark order quashing the letter of intent granted for the multi-crore Sahara project, has authored a book, Environmental Jurisprudence.

Published by the New Delhi-based Vikas Publishing House, Justice Kuldip Singh, retired judge of the Supreme Court and known for his numerous historic judgements on environmental matters, has written the foreward for the book. Desai has described Singh as his source of inspiration while writing the book.

The book deals with legislative aspects of the conservation of bio-diversity of sustainable development, population explosion, global environmental regulations and at the same, it also analyses the role of judicial activism in protecting the environment.

The book, which is the first scholarly exploration of environmental jurisprudence, begins by tracing the references and instructions in the Vedantic tenets, the Ayats of Allahand the preachings of Jainism and Buddhism dealing with the environment. It endeavours to analyse and consolidate various jurisprudential concepts and events from the Vedic era to the present day. Their impact on the development and codification of different environmental laws has also been discussed in detail in the book.

While Gandhian approach to the environment has been explored as an alternative, the book also highlights socio-economic constraints, which restrict more sweeping legislative measures.

This is the second book authored by Desai. Earlier, the judge had written a book, Justice versus Justices in 1994.
