NEW DELHI, JULY 7: The Government has expressed its reservations regarding Chief Justice of India MM Punchhi’s recommendations for the transfer of chief justices of three high courts. The recommendations were returned to Justice Punchhi requesting a “reconsideration.”

Punchhi had recommended that Madras high court chief justice MS Liberhan be transferred to the Guwahati high court as chief justice. The Government has held that both the Tamil Nadu Chief Minister and the Law Minister “have spoken against the transfer and transfer of Justice Liberhan can be misconstrued as a political move by the government and wrong signals may be transmitted by the transfer.”

It has further been pointed out that contrary to practice, Justice Liberhan was not consulted by Punchhi about his proposed transfer including his preference for the place of transfer. And that although Punchhi has said, in his note, that he did consult two judges of the Supreme Court, justices AS Anand and Venkataswamy, “their views have notbeen made available.”
