Who can file a complaint?
A consumer or any recognised consumer association, the State or the Central government.

Who is a consumer?
Any person who hires or avails of a medical service for a consideration which has been paid or partly paid and partly promised or under any system of deferred payment.There is no fee for filing a complaint.

How does one file a complaint?
A complaint is a written allegation that the consumer has suffered loss or damage as a result of deficiency of service. One can approach the the district forum if the value of services and compensation is less than Rs. one lakh, the State Commission if the compensation does not exceed Rs 20 lakhs and the National Commission if the value of goods or services exceeds Rs 20 lakhs.

What are the powers of the consumer redressal forums?

  • Summoning and enforcing attendance of any defendant or witness and examining them under oath.
  • Discovery and production of any document or material which can be produced as evidence.
  • Reception of evidence as affidavits.
  • Summoning of any expert evidence or testimony.
  • Requisitioning of the report of the concerned analysis or test from the appropriate laboratory or from any other relevant source.
  • Any other matter which may be prescribed.
