CHANDIGARH, Nov 2: Issuing notice on the anticipatory bail application moved by Druckgrafen Indian Limited's managing director J.L. Nanda - besides executive director Ved Nanda - for November 6, UT District and Sessions Judge B.S. Bedi also stayed their arrest till the same date, here today.The duo, accused of cheating and criminal conspiracy, were booked on October 29 by the Chandigarh Police on a complaint by Messrs Coats of India Limited "one of the creditors of Druckgrafen". In their complaint, the company's representative had alleged that Druckgrafen failed to make the payment of Rs 26,88,233 for certain supplies.Further, two cheques of Rs 3,33,590 and Rs 1,74,144, issued on April 5, 1997, had bounced. Fresh cheques, issued in their place, were also dishonoured, it had further been alleged.Today, seeking pre-arrest bail, the defence counsel stated that the allegations were false and the duo were being implicated in the case.Refuting the allegations of cheating and criminal conspiracy, he contended that their relationship with the complainant was of debtor-creditor, as such non payment by the latter did not constitute the offences under which they were booked. The dispute was civil in nature, the counsel added.The counsel claimed that the company had been making the payments to the complainant without delay from the very onset. Regarding the dishonouring of the cheques, the counsel stated that the complainant had been instructed by the company not to present the cheque. The outstanding balance was not paid as the amount was disputed, he added.The counsel also stated that the investigations in the case would not be hampered by the accused and the two would abide the conditions.
