
CHANDIGARH, April 8: UT Additional District and Sessions Judge S. S. Lamba today reduced the period of conviction from one year RI to nine-month RI in a bounced cheque case.
The revision in the period followed an appeal filed by the accused in the court against the earlier judgment of conviction and sentence announced on May 28, 1998. He had been sentenced to undergo one-year RI and pay a fine of Rs 5,000. In case of default of payment of fine, he was directed to undergo further RI for a period of three months.
The Additional Sessions Judge today observed that the sentence was somewhat on a higher side and reduced it to nine months. He also stated that in case of default of payment of fine, the accused would have to undergo RI for two months. the amount of fine was, however, not changed.
The accused borrowed Rs 30,000 from one S. C. Datta on December 18, 1995, saying that he wanted to buy a Maruti car.
The accused issued a cheque for Rs 31,200 drawn on Punjab State Cooperative Bank, which got dishonoured. Later, he again issued a cheque, which also bounced.
