Work withdrawn from ‘stung’ magistrate

All judicial work has been withdrawn from the court of Metropolitan Magistrate G K Niman at the Rohini Courts after he was allegedly recorded having a conversation to facilitate the release of an accused in a case.

As per the circular issued by Additional Chief Metropolitan Magistrate Ashutosh Kumar on Monday,Metropolitan Magistrate Neeraj Gaur has been allocated the work in Niman’s court. The circular was issued following a directive from the Delhi High Court,which is adjudicating the complaint against the magistrate who is accused of accepting favour from a man held guilty by him in a criminal case.

Nitin,Varun and Daljit were convicted by the magistrate on May 14 and May 26 was fixed for pronouncing the quantum of punishment. As per the complaint by Nitin,and the Rohini Court Bar Association, he managed to meet Niman on the night of May 23 and requested him not to send the trio behind the bars. Nitin allegedly promised favours to the magistrate in lieu of releasing them for good conduct. Nitin recorded his conversation and placed it before the Bar Association on May 26.

Bar Association secretary Rajiv Tehlan said when the lawyers confronted Niman,he tendered an apology. However,in an order sheet,the magistrate claimed he was manhandled inside his chamber by the lawyers who threatened him to release the convicts on probation.

The lawyers,as well as the magistrate,then wrote to the High Court,apprising it of their respective versions. Subsequently,members of the Bar met Chief Justice Dipak Misra and requested him to withdraw all judicial work from Niman to send a strong message to the establishment,said Tehlan.
