FIR ordered against Unitech in Gurgaon

3-year delay in possession, buyers allege builder took 95% payment.

A Haryana minister has ordered an FIR against realty firm Unitech for allegedly cheating its buyers. The matter came up at a grievance committee meeting in Gurgaon on Thursday. “After listening to the problems of people against the builder, I have ordered an FIR and have briefed the officers concerned. Action will be taken soon,” Haryana Agriculture Minister Om Prakash Dhankar told Newsline.

A senior officer said an FIR will be registered once the Economic Offences Wing sends it probe report.
At the grievance committee meeting, more than 30 buyers alleged that Unitech had to deliver 1,320 homes in its ‘The Residences’ project in Sector-33, Gurgaon by December 2011 as per the agreement it had signed.

The project started in May 2009 but, till date, only 90 flats have been delivered and more than 90 per cent of the project remains  abandoned, the buyers alleged.

They also alleged that only 10 per cent of the work could be seen on the ground though Unitech had taken 85-95 per cent of the total payment from customers, including parking charges. More than Rs 550 crore has already been collected by the developer in 2011, they alleged.

When contacted, a Unitech spokesperson  said, “The company is making every effort to resolve the grievances of the buyers. In the matter of ‘The Residences’ project, phase-wise hand-over of flats is on and 224 flats have already been offered for possession. Meanwhile, we are paying delay penalties to our allottees, as per buyer’s agreement.”

“After the completion of 30 months in December 2011, we held several meetings with the builder. However, each time, the builders gave us a new deadline. There has been a three-year delay beyond the committed  date of completion and Unitech still refuses to provide any firm timeline,” Vikram Bishnoi, who heads the buyers association for The Residences, said.

“In the meeting, the minister asked us to probe the entire issue and quickly file an FIR,” deputy commissioner Satyaprakash told Newsline.
Anoop Rana, a buyer, said, “The developer is wilfully delaying the project, as they have access to funds at 1.8 per cent interest per annum. It’s cheap money even after paying the penalty of Rs 5 per sq ft for the delay caused.”

Another  buyer, Shikha Puri, said she had to “sell her jewellery to buy this flat”. She was bearing the brunt of having to pay rent and EMIs at the same time, she said.
