HC orders status quo on land ‘released’ to private builders

In an embarrassment for the Haryana government,the Punjab and Haryana High Court on Wednesday ordered status quo on the possession of 111 acres of land allegedly released to private builders by the state in Rohtak.

In an embarrassment for the Haryana government,the Punjab and Haryana High Court on Wednesday ordered status quo on the possession of 111 acres of land — allegedly released to private builders by the state — in Rohtak.

The status quo was ordered by a division bench headed by Justice Hemant Gupta on a bunch of petitions filed by villagers in Rohtak,who had alleged that even after award of compensation for the land acquired by the Haryana government,111 acres were released to private builders.

Taking stock of the accusation,the bench stated that no further proceedings will take place with regard to the land till further orders. The case will now come up for resumed hearing on September 6.

On April 11,2002,the Haryana government had issued a notification for construction to take place for residential or commercial purposes in Sector 27 and 28 in Rohtak. The village,where land was ought to be acquired,is a part of Rohtak municipality and located very close to Rohtak town. On April 8,2003,a notification under Section 6 (finalising the amount of land to be acquired) was issued by the government.

Compensation to be paid to the farmers was decided on April 6,2005 and the same was disbursed. The petitioners had claimed that at the time of acquisition,they were forced to sell their land to private builders since they were offered more than the compensation offered by the state. Surprisingly,even after the the state paid compensation to those farmers who had not sold their land to private builders,the land from the final acquisition was released to builders in 2007 and 2008.

Aggrieved,the land owners had moved the high court in 2010.
