Kerala Solar scam: HC junks Saritha plea for CBI probe against Chandy

The court also posed a question whether a person accused in 33 criminal cases, allegedly involving crores of rupees from public, claim such a privilege.

Giving a breather to the Congress weeks before the state goes to the polls on May 16, the Kerala High Court on Monday dismissed a petition filed by solar scam accused Saritha S Nair seeking a CBI probe into the alleged role of Chief Minister Oommen Chandy.

The court observed that the petitioner cannot make use of the courtroom as a playground for politics before the Assembly elections.

Nair had moved the court pleading that Chandy should have been made respondent in the case as he was also an alleged party to the transactions in the solar case. The petition came up before the court a day after a TV channel aired a letter purportedly written by Nair in which she had alleged that Chandy had sexually abused her.

Observing that the petitioner’s attempt is politically motivated, Justice Kemal B Pasha said a person making such claims should have credibility in order to forward a claim for unfairness or malafide in investigation. But, the court said, a person accused in 33 cases for allegedly squeezing crores of rupees from investors cannot claim any such credibility.

Earlier in the day, Opposition leader V S Achuthanandan accused Chandy of misusing the state government machinery for alleged immoral activities of Congress leaders. A detailed probe should be conducted to bring Chandy and other ministers to the book, the CPM leader said, referring to Nair’s letter.
