‘Flaws of UT model’: NC MLA on L-G approval for Money Bill before tabling

Zadibal MLA and National Conference chief spokesperson Tanvir Sadiq Sunday criticised the provision of the J&K Reorganisation Act that mandates that a Money Bill to be presented in the Assembly has to go to the Lieutenant Governor for clearance first.

Citing “systemic flaws of the UT model” of governance in Jammu and Kashmir, Sadiq in a post on X, stated that he wanted to introduce a ‘crucial’ private members’ Bill — The Jammu and Kashmir War Against Drug Abuse and Compulsory Teaching of Ill Effects of Drug Addiction in Schools Bill, 2025 in the upcoming session of the J&K Assembly, set to begin on Monday.

However, since this involves financial matters and qualifies as a Money Bill, “I have been informed that I must seek the advice of the Law and Parliamentary Affairs Department and obtain approval from the Lieutenant Governor before proceeding further.”

Section 36 of the J&K Reorganisation Act underscores that a Bill or amendment “shall not be introduced in the Assembly without the recommendation of the Lieutenant Governor, if such a Bill or amendment makes provision for “any financial obligations undertaken or to be undertaken by the Government of the UT.”

The NC MLA stated that this “bureaucratic hurdle is yet another reminder of the systemic flaws of the Union Territory model— a model we have always opposed while demanding the immediate restoration of full statehood.” He asserted that as an elected representative, he remains committed to ensuring that this Bill reaches Raj Bhawan and is introduced in the Assembly in future because the “menace of drug abuse must be tackled with the urgency it deserves.”

Speaking at The Indian Express, J&K CM Omar Abdullah had said that the UT-model of governance was “flawed”. Sadiq posted a letter from the Assembly Secretariat in response to his Bill directing him to “obtain the recommendation” of the L-G…”
