Wife declared loan offender, JD(U) MLA says he spent it on Lok Sabha polls

The wife of a JD(U) MLA from Bihar has been declared a proclaimed offender in a loan default case by a Tarn Taran (Punjab) court.

For Dadan Yadav, a wrestler-turned-politician better known as Dadan Pahalwan, it marks yet another in a series of controversies — he had earlier refused to vacate a government bungalow in Patna and installed the statue of a controversial Yadav leader at his home.

Yadav, the MLA from Dumraon of Buxar, has taken responsibility for the loan, admitting he got his wife to take the Rs 31.5 lakh loan from a Delhi-based non-banking firm. The reason, he said, was to meet his expenses for the 2014 Lok Sabha elections, which he had contested and lost .

A court in Patti, Tarn Taran, declared Yadav’s wife Usha Devi a proclaimed offender in the case on December 3. First booked under provisions of the Negotiable Instruments Act, she was declared a proclaimed offender under CrPC provisions when she failed to honour a court summons.

“Statutory period of 30 days has since lapsed. Despite several calls, none appeared on behalf of the accused. Therefore, accused Usha Devi is declared as proclaimed person…,” first class judicial magistrate of Patti (Tarn Taran) Parvinder Kaur said in her December 3 order.

Usha Devi had taken the loan from Delhi-based Karina Fincap Ltd on April 12, 2014, just before Dadan contested the Lok Sabha elections.

Her son Kartar Yadav was the first guarantor and her daughter Jaya the second. Usha Devi, her son and daughter face another case over the same loan at a court at Dwarka of Delhi. The non-banking firm, which has offices in Punjab and New Delhi, has filed cases at both places, first on July 27, 2015, at the Dwarka court; then at the Tarn Taran court in August 2015.

The loan, according to the agreement, had to be fully repaid within four months. In nearly 30 months since the loan was given, Yadav’s family reportedly repaid only Rs 11.5 lakh and got several reminders about the rest, along with interest, from the firm.

“I am aware of the latest on the case,” Dadan Yadav told The Indian Express. “But we are going to settle the matter soon. It is not a loan. They [the non-banking firm] are our friends and we will sort it out.”

Asked if his wife would surrender in the Tarn Taran court, he reiterated: “Maamla suljha lenge (we will sort it out).”

Asked why his family needed Rs 31.5 lakh loan just a before the Lok Sabha polls, Yadav said: “I had to meet some election expenses.”

JD(U) spokesperson Neeraj Kumar said: “Dadan Yadav should ensure that his wife complies with the court order. The law must take its own course in such cases.”

Yadav is known for the colourful way he campaigns during elections, especially using a two-seater helicopter to move around. When he contested unsuccessfully from the Buxar Lok Sabha seat, he was a BSP candidate. He has also been with the Samajwadi Party earlier.

Although he lost in Buxar, Yadav swung enough votes to attract the JD(U)’s attention. He won the Dumraon assembly seat as as a JD(U) nominee in 2015.

Yadav, who used to sign as Dadan Singh until 2010, changed his name to Dadan Yadav in 2014 in an overt bid to woo Yadavs.
