SC rejects Talwars’ plea,trial to go on in Ghaziabad

Talwars want to shift the proceedings against them from a Ghaziabad court to Delhi.

The Supreme Court today rejected the plea of Rajesh and Nupur Talwar,who are facing trial for the murder of their daughter Arushi,to shift the proceedings against them from a Ghaziabad court to Delhi.

A bench of justices B S Chauhan and J S Khehar said there is “adequate” security in the Ghaziabad court and inconvenience to the Talwar couple cannot be a ground to transfer the trial to Delhi.

In view of the hype surrounding the trial,the bench,however,added that only the parties concerned and their counsel be allowed to attend the proceedings.

The couple had submitted that going for trial to Ghaziabad was traumatic for them and they faced a security threat there. The CBI had challenged this,saying the couple had tried earlier to delay the trial. The agency also said the petition might have been filed as the provision of anticipatory bail is not applicable in Uttar Pradesh.

Satish Tamta,lawyer for the Talwar family,welcomed the move to restrict the court proceedings only to the family and counsel. “A consistent problem with the Ghaziabad court was that lawyers not pertaining to the case entered the courtroom and started speaking about the case… On the issue of the security of the Talwar family,the Supreme Court has said there is ‘adequate security’ in the Ghaziabad court,so that should no longer be a problem.”

The only daughter of the Talwars,14-year-old Arushi,and their help,Hemraj,had been found dead at their Noida residence in May 2008. While the CBI had filed a closure report in the Ghaziabad court,saying it had been unable to find evidence to prosecute the Talwars,the court had rejected the same.
