While Bharati Developers, the builder of ‘Wonder Futura’ residential project in Kothrud, has partially kept its promise of handing over the possession of about 20 flats in phase II by January 14,Satish Mittal, partner,Bharati Developers, has now come up with a condition – that the individual consumer court cases filed by the residents in September 2009 be withdrawn. A total of 26 such cases are pending in the Pune District Consumer Redressal Forum.

The possession of these flats was delayed by two-and-a-half years, after which flat owners had staged an agitation and filed consumer court cases in September last year. After local Shiv Sena corporator Sham Deshpande intervened and held a meeting with the flat owners,Mittal had agreed to complete the backlog and hand over the flats by January 14.

“We have sent letters to 18 flat owners of the A and D buildings in phase II requesting them to take possession of their completed flats,” Mittal said. However, the letter states “sign possession deed/necessary document and simultaneously withdraw court matter or procure order from concerned court for taking possession.”

Those who have received the letter, however, say that though the flats are complete, amenities such as garden, digital home system,PMC water supply and so on are yet to be put in place. “Although we are not keen on taking the possession unless all of these are completed,we shall leave it to the court to give us the order to take possession of our flats in the present condition,” said Nikhil Roy,representative of Wonder Futura flat owners’ association.

The letter says “Electricity supply, piped gas and intelligent home features will be ready once the flats are handed over to the respective customers.Work on the parking lot is underway and will be ready in 6 to 8 weeks, while work on the garden and landscaping will be done after civil work is complete.”

Sham Vasu,a flat owner in phase I who took possession of his flat two years ago, said,“Amenities in this phase are still incomplete. We too were promised that these would be ready when we took possession. We are still waiting for these to be fully functional.”
