The family of Reeda Shaikh who died of swine flu filed a complaint with the Bund Garden police on Thursday against the directors of Jehangir Hospital,Ruby Hall Clinic and Dr Sanjay Agarwal,alleging negligence on their part.

Reeda’s aunt Ayesha Shaikh,her husband Majid Shaikh and lawyers submitted the complaint to senior police inspector Suhas Nadgauda. “The FIR will be registered after the panel of three government doctors appointed for conducting an inquiry into the case submits its report,” said Nadgauda.

Asif Lampwala,the lawyer representing Reeda’s family,said,“We have filed a written complaint against Dr Sanjay Agarwal and the directors of Jehangir Hospital and Ruby Hall Clinic. The police will investigate the matter as per their procedure.

“We have demanded an inquiry against the two hospitals and Dr Agarwal who is on the panel of Jehangir Hospital. Dr Agarwal could not diagnose the disease. He had treated Reeda for pneumonia.”

Meanwhile,the crime branch and officers of Bund Garden police have begun investigations. Police teams visited the hospitals on Thursday. “We are verifying certain documents. But the police are not medical experts. A three-member committee,including medical experts from the government and headed by a civil surgeon,has been appointed for probing the negligence charge,” assistant commissioner (crime) Sangramsinh Nishandar said.

“The committee is supposed to submit its inquiry report within two weeks. Once the report is available,the offence will be registered,” he said.

Apology sought

Reeda’s family has also moved the consumer court demanding a compensation of Rs 5 crore and an apology to the nation from Ruby Hall Clinic and Jehangir Hospital.

Advocate Lampwala said,“We have filed a separate suit in the consumer court demanding compensation of Rs 5 crore and apology to the nation from the doctors.”

“The legal notice regarding compensation and apology has been issued to the directors of Jehangir Hospital and Ruby Hall Clinic today. It has been dispatched by post and the hospitals will receive it in a day or two. The hospitals have been given 48 hours to respond.”
