Pune Porsche crash: Probe panel finds lapses in punitive measures handed to minor by Juvenile Justice Board

State Women and Child Development Commissioner Dr Prashant Narnaware issued a show cause notice against two non-judicial members of the Juvenile Justice Board (JJB), directing them to respond to the findings of the investigation committee in the Pune Porsche car crash case within four days. The showcause notice was issued on Friday.

When contacted, Dr Narnaware told The Indian Express that a show cause notice had been issued to two non-judicial members of the JJB. “We have asked them to respond to the notice within four days and then the report will be submitted to the state government,” Dr Narnaware said.

Shortly after the crash on may 19, a five-member committee had been appointed by the WCD after they prima facie found a case where the 17-year-old accused minor was hurriedly granted bail by a JJB member and directed to write an essay. The JJB had come under severe flak for allowing the 17-year-old to go free without any stern punitive measures.

It was learnt from highly placed sources in the know of the report, that the committee conducted their own investigation into the case, obtained several documents and now, in their 100-page report, have highlighted several discrepancies. Among the major lapses that have been reported by the committee was that the bail order initially passed by one JJB member was also supported by two other members.

In their report, the committee said that the other members need not have supported the bail order, according to sources.It was also noted that the decision could have been overturned by the other members. Another lapse that was observed was that the JJB did not maintain a proper roster and it was unclear as to which member would be present in case of the other’s off day. The committee has found several other lapses, including that many medical reports were unclear and it was unclear on what basis the decision was taken.

It is nearly a month since the incident occurred on May 19, when the minor allegedly driving the Porsche collided with a motorcycle at Kalyani Nagar, resulting in the deaths of two techies Anish Awadhiya and Ashwini Koshta. While several arrests have been made in the case, the JJB has extended the accused’s remand in an observation home till June 25.
