Coming down heavily on the local police,a special court has called for reinvestigation into a case pertaining to the rape of a minor Dalit girl. The police had submitted that the case should be closed,as sought by the victim.
The court slammed the police for its insensitive attitude while probing the case. According to police records,the minor girl was raped by the wards of a few influential families in 2008. The victim gave birth to a baby girl on April 19,2009,shortly after which her parents hurriedly married off the girl and left their village near Moga.
The police had filed for cancellation of the FIR in the case. Turning down the request,Additional Sessions Judge Raj Shekhar Attri ordered reinvestigation into the case,asking the Moga senior superintendent of police to appoint a senior officer for the purpose.
The FIR was registered against six persons in 2009 and that too only after the victim had given birth to her child. The police later added charges under the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act 1989 in the FIR.
Citing reasons for a reinvestigation into the case,the judge said the investigation conducted by the police showed an insensitive attitude of the police. He said the documents presented in the court while seeking cancellation of the FIR had the victims signatures in some places and thumb impressions at other,which raised question marks.
Dalip Singh Pandhi,member of the Punjab Scheduled Castes Commission who has been pursuing the case,has,meanwhile called for a DNA test of the victim,her child and all six accused. The police cannot ignore the fact that a crime has taken place. This girl was raped and as a result she gave birth to a child. The police cannot get away with the plea that the girl wants the case closed. She is a minor and it is the duty of the police to get her justice, he said.
