On non-minority seats in Maharashtra: Minority institutions body to move court against state decision to apply quota

The Maharashtra Association of Minority Educational Institutions is going to approach court on Tuesday against the state government’s decision to apply SC/ST/OBC reservation on their non-minority seats in admission to First Year Junior College (FYJC).

The association had earlier written a letter to Maharashtra School Education Minister Dada Bhuse, urging him to withdraw the decision.

Stating that this is imposed by the government without any official written order, the association had stated in their letter that “the move is not only legally untenable but also contradicts established norms and various court rulings.”

The principal of one minority-trust-run junior college in the city said, “There was no response to the letter from the state government. After having officially registered our dissent with the government, when there is no communication, it has been decided to go ahead with the legal course of action.”

Apart from this association, individual trusts from across Maharashtra too are planning to move court against the government’s decision to apply SC/ST/OBC reservation in minority-trust-run colleges for FYJC admissions. One such trust is S.A.P.D.J. Pathshala Trust from Solapur.

When contacted, an official from the trust confirmed that they too are planning to move court against the same issue.

This year, a major controversy erupted in FYJC admissions after the state government decided to apply SC/ST/OBC reservation on non-minority seats of minority-trust-run junior colleges. According to colleges, they are excused from this reservation as they already have 50 percent of seats reserved for minorities and five percent reserved under management quota. As per regular practice, remaining 45 percent seats are filled based only on merit.
