The Bombay High Court public prosecutor’s office has urged the police to draft by July 30 an appeal against the acquittal of two Indians in the 26/11 attack case.

The Bombay High Court public prosecutor’s office has urged the police to draft by July 30 an appeal against the acquittal of two Indians in the 26/11 attack case. Fahim Ansari and Sabahuddin Ahmed,accused of involvement in the plot,had been acquitted for lack of evidence while Ajmal Kasab was sentenced to death.

Public prosecutor P A Pol wrote to Joint CP (Crime) Himanshu Roy on Tuesday,requesting him to coordinate with special public prosecutor Ujjwal Nikam for drafting the appeal memo and application as early as possible so that these may be submitted to the prosecutor’s office by July 30.

The appeal needs to be filed by August 4,90 days after the judgment,and the prosecutor’s office will need at least five working days to process the application before filing the appeal,the letter says. There is,however,a provision for extending the deadline depending on the date when a certified copy of the judgment is procured. In this case,the certified copy arrived 18 days after the judgment was pronounced,sources said.

As reported earlier,the police have sent a draft appeal to the law and judiciary department for approval. The government has appointed Ujjwal Nikam as special public prosecutor to argue for the confirmation of Ajmal Kasab’s death sentence and against the acquittal of Ansari and Sabahuddin.

Kasab’s lawyers,meanwhile,hope to file his appeal against the sentence by the first week of August.
