BMW hit-and-run accused moves HC seeking immediate release

The main accused in the BMW hit-and-run incident in which a 45-year-old woman was killed at Worli in Mumbai last month, Mihir Shah, approached the Bombay High Court claiming that his arrest is illegal.

Pending the hearing of his habeas corpus plea, filed on August 14, Shah has sought to be immediately released as he claims the remand orders were passed without following due process.

A division bench of Justices Bharati H Dangre and Manjusha A Deshpande is likely to hear his plea on Wednesday.

The petitioner claimed that the arrest grounds were not given as per Section 50 of the Criminal Procedure Code (CrPC) and his fundamental rights of personal liberty among others were violated due to illegal detention. Stating that the police failed to follow constitutional mandate, the petitioner sought quashing of remand orders and his immediate release.

Shah, 24, is the son of Rajesh Shah, a Shiv Sena leader close to Chief Minister Eknath Shinde. While Rajesh was granted bail, Mihir and their driver Rajrishi Bidawat are in judicial custody in the case.

Last month, Shah allegedly rammed a BMW car he was driving into a two-wheeler on which Pradip Nakhwa, 50, and his wife Kaveri Nakhwa, 45, were travelling. Kaveri was allegedly dragged for nearly 2 km after she got stuck between the car’s bumper and tyre. She was later flung onto the road, leading to her death.
